Terms of Service

1. Provider and contact

The provider of the application available at openfarmplanner.org is: Martin Stipsitz Burgenlandstraße 44A / 9 9500 Villach Austria Email: [email protected] There is currently no VAT identification number.

2. Scope and use of the platform

These Terms of Service apply to the use of OpenFarmPlanner, a web application for planning agricultural and horticultural cultivation. By registering a user account or using the application, you accept these Terms of Service. OpenFarmPlanner is intended for private individuals as well as agricultural and horticultural businesses that want to organize their cultivation planning digitally. Information on the processing of personal data can be found in the Privacy Policy.

3. Service scope

OpenFarmPlanner provides digital planning functions as a hosted web application.

4. User accounts

A user account is required to use the application. You are obliged to provide truthful information during registration and to keep your password confidential. You are responsible for all activities carried out through your user account. Please inform us immediately at [email protected] if you suspect that someone has gained unauthorized access to your account. A user account is personal and non-transferable.

5. Your content in OpenFarmPlanner

Within your projects, you can create your own data, such as location, field and crop data, cultivation plans, tasks, notes, and photos. You are responsible for the accuracy, completeness, and legality of this content. Do not upload content for which you do not have the necessary rights, such as copyrighted photos of third parties.

6. Public crop library

You can voluntarily publish individual crop records from a private project into the public crop library. This library is intended as a collaboratively built, permanently maintained knowledge base for agricultural and horticultural crop data. Published entries are visible to other users, can be imported into their own projects, and may in the long term be reused through features such as version histories, collaborative editing, comments, ratings, public APIs, or data exports. By publishing, you confirm that the published information is accurate to the best of your knowledge, contains no personal data of third parties, and that you are entitled to publish it permanently under the open license named in these terms of service.

7. Open license for published crop data

When you publish a crop record to the public crop library, you license the published crop data under the Creative Commons Attribution-ShareAlike 4.0 International license (CC BY-SA 4.0). This license in particular allows third parties to reproduce, distribute, edit, and combine the published crop data with other data, and to use it commercially, provided the license terms are followed. These terms include, in particular, appropriate attribution, an indication of the license, and sharing modified versions under the same or compatible terms. Once validly granted, the license is irrevocable under its terms. OpenFarmPlanner may permanently store and display the published crop data, include it in search and import features, make it available in public data exports or APIs, technically process it, and further develop it as part of the collaborative crop library.

8. Prohibited content and behavior

When using OpenFarmPlanner, especially when publishing content in the public crop library, it is not permitted to

  • post unlawful, misleading, or third-party-rights-infringing content (for example copyright or personality rights),
  • distribute malware or bypass security measures of the application,
  • misuse the application in an automated way, for example through mass registrations or spam,
  • impersonate another person or knowingly publish false information.
9. Copyright

The OpenFarmPlanner software is protected by copyright and is licensed under the license named in the "Open-source software" section. The content you enter, such as crop data or notes, remains your property. If you believe that an entry published in the public crop library infringes your copyright or other rights, please contact [email protected]. We investigate justified notices (see the "Content removal" section).

10. Content removal

Published entries in the crop library are generally intended to remain permanently and are not removed as a normal user feature on request. However, we reserve the right to remove, block, or anonymize published content in whole or in part, or to correct it in the future through moderation or versioning features, where there are concrete indications of a violation of these terms of service or applicable law. This applies in particular to legal violations, personal data in the published record, spam, obvious abuse, misleading information, or a moderation decision. You can report suspected unlawful or problematic content at any time to [email protected]. We are not obliged to carry out general, proactive monitoring of published content.

11. Suspension of user accounts

In the event of a serious or repeated violation of these Terms of Service, we may temporarily restrict access to your user account or suspend the account. We proceed proportionately and take into account the severity of the violation and whether it is an isolated or repeated incident. In the event of suspension, we will inform you of the reason where possible. You can contact [email protected] at any time about this.

12. Liability

OpenFarmPlanner is developed and operated with great care. Nevertheless, we cannot guarantee error-free or uninterrupted availability at all times, for example during maintenance, technical disruptions, or events outside our control. The public crop library contains content created by users themselves. The respective publishing users are responsible for its accuracy, not OpenFarmPlanner (see the "Your content in OpenFarmPlanner" section). Agricultural and horticultural information in OpenFarmPlanner, such as growth and harvest periods, plant spacing, or seed quantities, is intended only to support your own cultivation planning and does not replace professional advice. For damages resulting from slightly negligent breaches of duty, our liability is limited. Our liability for intent and gross negligence as well as for damages resulting from injury to life, body, or health remains unaffected, as do other mandatory statutory liability rules.

13. Open-source software

The OpenFarmPlanner source code is published as open-source software under the GNU Affero General Public License Version 3 (AGPLv3) and can be viewed, reused, and modified in the OpenFarmPlanner GitHub repository (https://github.com/OpenFarmPlanner/planner). The license regulates only the rights to the software itself and, as is common with open-source software, excludes any warranty for the software. This is separate from use of the hosted application at openfarmplanner.org, which is governed by these Terms of Service.

14. Further development of the platform

OpenFarmPlanner is continuously developed. These Terms of Service apply analogously to future features around user-provided content, such as comments, ratings, or version histories for entries in the public crop library. In the case of material new functions of this kind, we will update these Terms of Service if necessary (see the "Changes to these Terms of Service" section).

15. Changes to these Terms of Service

We update these Terms of Service if the offered functions or legal framework change. The version published within the application at the time of your use is authoritative; the date of the last change can be found at the top of this page. In the event of material changes, we will inform active users in an appropriate way, for example by email or through a notice in the application.

16. Language versions

This document is provided in German and English. In the event of any discrepancy or ambiguity between the language versions, the English version shall prevail.
